These Terms and Conditions govern the use of NexysCloud services, websites, and platforms. By using our services, you agree to these terms.

“NexysCloud”, “we”, “us”, or “our” refers to NexysCloud and its operating entities.
“You” refers to the customer or user of our services.


2. Services

NexysCloud provides cloud-based hosted PBX, VoIP communication services, and related features. Services are delivered electronically and require an internet connection.

We may update, modify, or improve services from time to time.


3. Account Responsibility

You are responsible for:

Maintaining accurate account information

Keeping login credentials secure

All activity performed under your account

NexysCloud is not responsible for misuse caused by compromised credentials.


4. Acceptable Use

You may not use NexysCloud services for:

Illegal activities

Fraud, spam, or harassment

Abuse of network resources

Unauthorized call recording

We reserve the right to suspend or terminate services for violations.


5. Billing & Payments

Services are billed monthly unless otherwise agreed

All fees are payable in advance

Late or failed payments may result in service suspension

Pricing is subject to change with reasonable notice.


6. Service Availability

While NexysCloud aims for high availability, uninterrupted service is not guaranteed.
We are not liable for outages caused by:

Internet service providers

Power failures

Third-party infrastructure

Force majeure events


7. Limitation of Liability

NexysCloud is not liable for indirect, incidental, or consequential damages, including loss of business or revenue.


8. Termination

Either party may terminate services with written notice in accordance with the agreed notice period.


9. Governing Law

These terms are governed by the laws of the Republic of South Africa.

Refund Policy

Digital Services

NexysCloud provides digital and subscription-based services.

Setup fees, usage charges, and monthly subscriptions are non-refundable once services are provisioned.

Refunds may be considered only in cases of:

Billing errors

Duplicate charges

Services not activated as agreed

Refund requests must be submitted within 7 days of the charge.

Physical Products

NexysCloud sell physical products through its online store and each product carry a one year carry / send in warranty from date of purchase.

Returned products should be returned to NexysCloud with all the original packaging and content in a as new condition to quality for a refund and any missing items will be deducted from the refund amount.

Items returned without original packaging and content will be refunded on a used goods scale.

Items returned need to be returned to NexysCloud within 7 days of purchase to qualify for a refund.

POPIA Compliance Notice

NexysCloud complies with the Protection of Personal Information Act (POPIA) of South Africa.

Call recordings, where enabled, are controlled by the customer. Customers are responsible for ensuring lawful consent for call recording in accordance with South African law.

South African law requires that at least one party to a conversation consents to recording. Customers are responsible for ensuring compliance with all applicable laws and regulations, including disclosure to call participants where required.

NexysCloud is not responsible for unlawful use of call recording or communication services by customers.
